These Terms explain the rules that apply when you use https://simplelivingcontractors.com/, submit a project inquiry, request information, or communicate with Simple Living Contractors through the Site.

1. Agreement to These Terms

These Terms of Service (“Terms”) govern your access to and use of https://simplelivingcontractors.com/ (the “Site”), operated by Simple Living Contractors (“Company,” “we,” “us,” or “our”). By accessing the Site, submitting a project inquiry, requesting an estimate, or otherwise communicating with us through the Site, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

You must be at least 18 years old and able to enter into a legally binding agreement to use the Site. If you use the Site on behalf of a company, property owner, association, or other entity, you represent that you have authority to act for that entity.

2. SMS Messaging Terms and Compliance

Program Description and Consent

If you provide a mobile number and expressly opt in to text messaging, Simple Living Contractors may send messages related to your inquiry or requested services. Messages may include project inquiry follow-up, appointment or walkthrough confirmations, reminders, scheduling updates, estimate-related communications, and customer support. Consent is collected through a separate SMS checkbox or another documented opt-in method and is not a condition of purchase.

By opting in, you confirm that you are the subscriber or customary user of the number provided and authorize messages to that number. Message frequency varies according to your interactions with us. Message and data rates may apply.

Opt-Out and Support

You may revoke consent at any time by replying “STOP” to a message. We may send one final non-promotional message confirming the opt-out. After that confirmation, no further messages requiring consent will be sent unless you opt in again. You may also communicate a clear request to stop through another reasonable method.

SMS Privacy

Mobile information, text-message opt-in data, and consent records will not be sold or shared with third parties or affiliates for their marketing or promotional purposes. Information may be provided to messaging platforms, aggregators, carriers, and service providers only as necessary to deliver and support the messaging service. See our Privacy Policy for details.

3. Website Information, Inquiries, and Estimates

The Site provides general information about our construction, renovation, outdoor living, and design services. Content is provided for informational purposes and may not describe every service, project condition, regulatory requirement, or geographic limitation. Service availability is confirmed directly by the Company.

A contact form submission, phone conversation, walkthrough, preliminary discussion, or estimate request does not create a contractor-client relationship and is not a binding offer or construction agreement. Project scope, price, payment terms, schedule, warranties, change-order procedures, and other project obligations are governed only by a separate written agreement signed by the applicable parties. Preliminary estimates may depend on assumptions and information available at the time.

4. Acceptable Use

You agree not to use the Site to:

  • Violate applicable law or the rights of another person or organization.
  • Submit false, misleading, fraudulent, unlawful, or infringing information.
  • Attempt to gain unauthorized access to the Site, its systems, or another user’s information.
  • Introduce malicious code, interfere with Site operation, or conduct automated scraping without permission.
  • Use Site content for unauthorized commercial exploitation or impersonate the Company.

5. Intellectual Property

The Site and its text, graphics, logos, photographs, videos, designs, layouts, and other materials are owned by Simple Living Contractors or used with permission and are protected by applicable intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal or internal business evaluation.

Unless we provide written authorization, you may not copy, reproduce, republish, modify, distribute, sell, license, create derivative works from, publicly display, or commercially exploit Site materials. You may print or save a reasonable number of pages for your own non-commercial reference if all copyright and proprietary notices remain intact.

6. Information and Materials You Submit

You represent that information, photographs, plans, drawings, documents, reviews, or other materials you submit are accurate to the best of your knowledge and that you have the right to provide them. You grant us a non-exclusive license to use submitted materials only as reasonably necessary to review your inquiry, communicate with you, evaluate a potential project, provide requested services, maintain business records, or comply with law.

Do not submit sensitive personal information through a general website form unless we specifically request it through an appropriate channel. Project photographs or materials will not be used publicly for marketing solely because they were submitted through the Site; separate permission may be requested.

7. Third-Party Services and Links

The Site may link to or use services provided by third parties, such as website hosting, analytics, mapping, scheduling, form processing, communications, social media, or payment providers. Third-party services are governed by their own terms and privacy practices. A link or integration does not imply that we control or endorse every aspect of that provider, and we are not responsible for third-party content, availability, or practices.

8. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF ANY KIND RELATING TO THE SITE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR COMPLETE.

This website disclaimer does not replace or alter any express warranty or obligation contained in a separate signed construction or design agreement.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE. ANY LIABILITY ARISING FROM A SEPARATE PROJECT AGREEMENT IS GOVERNED BY THAT AGREEMENT.

10. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless the Company and its owners, officers, employees, agents, and affiliates from claims, damages, liabilities, costs, and expenses arising from your misuse of the Site, violation of these Terms, or infringement of another person’s rights.

11. Suspension and Termination

We may restrict or terminate access to the Site when reasonably necessary to protect the Site, our business, users, or third parties, or when we believe these Terms or applicable law have been violated. Provisions that by their nature should survive termination will remain in effect.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Before filing a formal claim concerning the Site, the parties agree to make a good-faith effort to resolve the issue informally. To the extent permitted by law, unresolved disputes relating solely to these Terms or the Site will be resolved through binding individual arbitration in Duval County, Florida, except that either party may bring an eligible matter in small claims court or seek injunctive relief for misuse of intellectual property. Project disputes are governed by the dispute terms in the applicable signed project agreement.

13. Changes to These Terms

We may update these Terms from time to time. The revised version will be posted on the Site with a new effective date. Your continued use of the Site after the revised Terms become effective constitutes acceptance of the updated Terms.
